Terms of service

Short version: the tools help you research, the decisions are yours. You buy Pro from our reseller Creem, which also handles invoices, withdrawal and refunds. You can cancel at any time. The German version (Nutzungsbedingungen) is authoritative.

1. Provider and scope

These terms apply to this website and to the browser extensions "KDP Niche Check" and "Keyword Expander for Amazon" (together "the tools"). The provider is Mika Schicke, Herzog-Adolf-Straße 1, 65812 Bad Soden am Taunus, Germany, trading as "Hawkshelf" ("we"). Contact: hawkshelf@gmail.com.

2. What the tools do

The tools analyse Amazon pages you opened yourself and query Amazon's public search suggestions. The free version is limited to a number of analyses or runs per day. Pro removes that limit and unlocks the features listed on each product page. Estimates, such as sales derived from the bestseller rank, are approximations and may differ considerably. Whether and how you use them for business decisions is up to you.

3. Buying Pro

Pro is sold by our reseller Creem (Armitage Labs OÜ, Rotermanni 14, 10111 Tallinn, Estonia) as merchant of record. Creem's terms apply to purchase, payment, invoice, the right of withdrawal and refunds. Pro is a subscription that renews monthly or yearly until you cancel it. You can cancel at any time with effect from the end of the paid period, through Creem's customer portal or by email to us. Pro stays active until then.

4. License

With your purchase you receive a license key. It entitles you to use Pro for your own purposes on up to three devices. The key is not transferable; sharing or reselling it is not allowed. The tools and their code are protected by copyright. Your statutory rights remain unaffected.

5. Acceptable use

Use the tools as intended and in line with Amazon's terms. In particular, automated bulk queries through the tools, circumventing the free quota or the license check, and sharing license keys are not allowed. In case of such misuse we may block the license key concerned.

6. Availability and changes

The tools depend on Amazon pages and services, which may change without notice. We fix resulting problems as quickly as reasonably possible but cannot promise uninterrupted availability. We keep developing the tools. Changes to Pro during a paid period are governed by the statutory rules for digital products (Section 327r of the German Civil Code).

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. For the free version we are liable only for intent, gross negligence and injury to life, body or health. Your statutory rights in case of defects of Pro remain unaffected.

8. Privacy

What data is processed is described in the privacy policy.

9. Final provisions

German law applies. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence.
